OS X relies on the Darwin kernel, which is open source.

All this means is that you'll need to point your system to a kernel not 
provided by Apple -- which (surprise!) most hackintosh users are already 
doing anyway...In a worst-case, you'll just need a kernel built against 
a more generic architecture, and not the Atom, specifically.  It's 
hardly a death blow against the hackintosh scene. Infact, were talking 
about something that can probably be solved with a single ln -s command.

On a related note, show me one instance, just one, of any method of 
preventing "unauthorized use" that has stood the test of time, and i'll 
personally PayPal you $5. :) Again, Apple cannot make laws. The concept 
of an "authorized user" is an invented, contrived, logically 
unenforcable, and legally ambiguous bullshit term that Apple and other 
companies created to leverage control over their customers. I could just 
as easilly tell Steve Jobs he's not "authorized" to know what OS is 
running on my computer. What's the difference between them and I? By the 
way, hold on, let me authorize you to answer that question. Ok, you're 
officially authorized.

It makes about as much sense as General Electric saying i'm not 
"authorized" to use my toaster for Pop Tarts because Pop Tarts aren't 
bread. A computer, just like a toaster, is an appliance. It's an 
appliance, not a magical fucking portal into the netherworld with 
unicorns and pixies that must be guarded by Microsoft, or Apple, or any 
other company for my own safety and well-being.
