I agree.  Also if one has an internet connection in place & connected to their wifi, I would think that would be defense.

Clearly the violation only occurs if someone does this "with the intent to 
defraud", so Joe Bleau Innocente should be clear of this.  However, if you 
understand what you're doing, you're not clear.
